Intellectual property rights have undergone a significant expansion that began with the Copyright Act of 1976. Judge Richard Posner will discuss intellectual property law and present a new theory to explain why it is expanding. He will argue that public choice--wherein individuals, interest groups, and politicians pursue their own self interests when making decisions--is helpful in explaining the expansion of intellectual property rights. However, a complete explanation must include other key factors, including political and ideological beliefs and the institutional characteristics of courts and legislatures.
