The International Criminal Court remains one of the most pressing international obstacles to the American foreign policy agenda. While the United States has withdrawn its signature of the treaty, the ICC has constituted itself, appointing initial judges and a prosecutor. Difficult questions concerning authority over American officials, servicemen, and civilians participating in the global war against terrorism, the continuing operations in Afghanistan, and the reconstruction of Iraq have yet to be resolved.
