Plaintiffs’ lawyers have turned from suing individual doctors and tobacco companies to suing a variety of health care providers. These class action suits do not overtly challenge the legitimacy or wisdom of managed care as a means of delivering health services. Many believe, however, that the success of the suits would severely constrain the ability of health care providers to offer managed care. The purpose of this session is to describe and assess the likely effects of these challenges on health care providers and patients.
